% 26.10.2016 Respondent Nos.2 and 3 are parents and respondent No.4 is the widow of the deceased, namely, Manish Kumar, who was working in the factory of the petitioner. It is submitted that it is a small-scale factory, where only 6/7 workers used to work. While working on a machine, the deceased was electrocuted and died.

Respondent Nos.2 to 4 have settled the matter vide Settlement Agreement dated 12th August, 2015. They state that they have settled the matter voluntarily and without any force and undue influence or pressure.

The petitioner has paid Rs.1,50,000/- each to respondent Nos.2 and 3 and Rs. 4,50,000/- to respondent No.4, in terms of the Settlement Agreement. During the course of hearing of the present petition, the petitioner agreed to pay Rs.2,50,000/- to the minor child, Master Ansh Kumar, who was born, after the death of the deceased. The said amount of Rs.2,50,000/- has been paid by way of an FDR dated 14th October, 2016 in favour of Master Ansh Kumar, drawn on Oriental Bank of Commerce. A photocopy of the FDR is taken on record. The original FDR has been handed over to respondent No.4.

Respondent Nos.2 to 4 state that they do not wish to pursue the FIR any further and the same may be quashed.

Keeping in view the above facts, FIR No.0533/2015 under Sections 287/304A registered at PS:G.T.B. Enclave, Delhi, which is at the investigation stage, is quashed in terms of the compromise arrived at between the petitioner and respondent Nos.2 to 4. The petition is disposed of in the above terms.
