O R D E R

% 22.12.2016 This is an application Section 438 Cr.P.C. filed on behalf of the petitioner for grant of anticipatory bail in case FIR No.06/2015, under Sections 323/341/325/308/34 IPC, registered at Police Station Ranjit Nagar, New Delhi.

Learned counsel for the petitioner has submitted that the petitioner is an innocent person and is of 64 years of age and a senior citizen. Counsel further submits that the petitioner is not the main accused. Counsel further submits that the petitioner was asked to join the investigation, however, the charge-sheet has already been filed. Counsel further submits that the petitioner is not required for the purpose of further investigation since the charge sheet has already been filed and prays that the petitioner may be

released on bail.

On the other hand, learned APP for the State vehemently opposes the grant of bail to the petitioner and submitted that the charge sheet has already been filed against the petitioner before the Court below and he may approach the concerned Court for grant of regular bail to him. Keeping in view the facts and circumstance, since the petitioner was granted interim bail vide order dated 7th October, 2016, in these circumstances, the petitioner is admitted to bail, on his furnishing bail bond in the sum of Rs.20,000/- with one surety of the like amount, to the satisfaction of the concerned M.M. with the condition that he shall not tamper with the prosecution evidence and shall not leave the country without prior permission of the Court concerned and shall also not visit the house of the injured/complainant till the disposal of the case. However, this order shall not affect the merits of the case.

The present bail application is allowed and stands disposed of accordingly.
