% 07.10.2016 Crl. M.A. No. 15903/2016 Exemption allowed, subject to all just exceptions. The application stands disposed of.

W.P.(CRL) 2969/2016 The petitioners have filed the present petition seeking quashing of FIR No.1301/2014 registered on the complaint of the complainant under

Sections 120B/ 406/ 420/ 468/ 471/ 506 IPC against the petitioners at Police Station - Moti Nagar.

Issue notice. Mr. Singh accepts notice on behalf of the State. He states that the charge-sheet has been filed under section 406/ 420 IPC. Notice is accepted by respondent No.2/ complainant. He is present in Court in person and also represented through counsel. His counsel states that he has already filed his Vakalatnama. He identifies the complainant. The parties have arrived at a settlement on 13.07.2016, which has been placed on record. Under the settlement, out of the total settlement amount of Rs.3 Lakhs, the complainant has already received an amount of Rs.1.5 Lakhs. An amount of Rs.1.5 Lakhs has been tendered to him in Court today. The complainant states that he has not been subjected to any pressure or coercion and that he has entered the settlement out of his own free will. The complainant further states that he joins the prayer for quashing of the FIR in question.

Accordingly, no useful purpose would be served in proceeding further with the FIR in question, the charge-sheet and the proceedings emanating therefrom. The same are hereby quashed.
