% 31.08.2017 Notice could not be issued as process fee was not filed. However, respondent no.2 is present in court and has been identified by SI Mohd.Inam of PS Jama Masjid.

Respondent no.2 submits that the petitioner is his maternal uncle. A quarrel took place between them on some trivial matter, which led to the registration of present FIR No.108/2015 under Section 308 IPC at PS Jama Masjid at the instance of respondent no.2. The respondent no.2 submits that he had sustained simple injury in the quarrel. He says that he has now settled the matter with petitioner of his own free will vide Memorandum of Understanding dated 25.07.2017. He says that he is not willing to pursue the FIR any further and the same may be quashed. Keeping in view the settlement arrived at between the petitioner and respondent no.2 voluntarily, in the interest of justice, FIR No.108/2015 under Section 308 IPC at PS Jama Masjid and consequent proceedings

emanating therefrom are quashed.

Petition is disposed of in the above terms.
