CRL.M.C. 3853/2016 This is a petition under Section 482 Cr.P.C. for quashing of FIR No.99/2014, under Sections 498-A/406/34 IPC, registered at Police Station Crime(Women)Cell, Nanakpura, Delhi.
Learned counsel for the petitioners submits that all the petitioners are present and the petitioner No. 1 is husband, petitioner No.2 is father-in-law, petitioner No.3 is mother-in-law, petitioner No.4 is sister-in-law, petitioner No.5 is brother-in-law and petitioner No.6 is sister-in law of the
complainant.
Counsel for the petitioners has submitted that the complainant is the wife and the matter has been settled between the parties and the marriage between the petitioner husband and the complainant is dissolved vide divorce dcree by mutual consent dated 04th July, 2016 passed by Ms.Poonam A.Bamba, Principal Judge, Family Court, South Saket, New Delhi. The complainant is present in person with counsel Mr.Dheeraj Kumar Singh. The complainant is identified by the Investigating Officer SI Asha, Police Station-Nanakpura.
The complainant has admitted that she has received the last instalment of Rs.1,12,500/- through demand draft bearing No. 316510 dated 18th October,2016 drawn on Union Bank. The complainant submits that she has no objection if the present FIR No. 99/2014, under Section 498A/406/34 IPC, registered at Police Station-Crime (Women) Cell Nanak Pura, Delhi is quashed.
Since the marriage has already been dissolved vide mutual consent vide order dated 4th July, 2016 and the complainant has no objection if the FIR in question in quashed. In view of the above no useful purpose will be served to continue with the proceedings under Sections 498A/406/34 IPC. In these circumstances, FIR No. 99/2014, under Section 498A/406/34 IPC, registered at Police Station-Crime(Women) Cell Nanak Pura, Delhi and all the proceedings arising therefrom are quashed.
