IN THE HIGH COURT OF DELHI AT NEW DELHI

+ W.P.(C) 9501/2018 & CM No. 36986/2018 SADGURU CONSCIOUSNESS SOCIETY ..... Petitioner Through Mr Anisha Upadhyay, Advocate.

versus DIRECTORATE GENERAL OF TRAINING AND ANR.

..... Respondents Through Mr Nitish Gupta, Mr Ravi Prakash, CGSC for UOI.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 11.09.2018 1.

Issue notice. The learned counsel appearing for the respondents accepts notice.

2.

The petitioner has filed the present petition, inter alia, praying as under:- "direct the respondent to re-consider the Application No. A16002592 of the petitioner and accordingly grant affiliation for the trade of fitter."

3.

The petitioner is a Society registered under the Societies Registration Act, 1860.

On 11.03.2016, the petitioner had applied to the National Council for Vocational Training (hereafter 'NCVT') for affiliation to impart vocational training for the 'fitter trade'. The petitioner states that it was informed that the said application was placed before a Sub-Committee of NCVT, in a meeting held on 08.11.2017. Subsequently, NCVT had also

sought certain clarifications from the petitioner. 4.

Thereafter, in April 2018, the petitioner became aware from the website of the respondent that its application was rejected. The learned counsel appearing for the petitioner states that it has also filed an appeal dated 11.04.2018 against the said decision before the Appellate Committee as per the in the format as provided on the NCVT's website. 5.

The petitioner's grievance is that it has received no information with regard to its appeal.

6.

Since the petitioner's appeal against the order rejecting affiliation is pending before the Appellate Committee, this Court does not consider it necessary to entertain the present petition for the relief as sought by the petitioner. However, it is apposite to direct that the Appellate Committee consider the petitioner's appeal as early as possible and preferably within a period of 8 weeks from today. It is so directed. 7.

Needless to state that if the petitioner is aggrieved by the decision of the Appellate Committee, the petitioner would have liberty to take recourse to its remedies as available in law.

8.

The petition and the pending application are disposed of in the aforesaid terms.
