1. It appears that the IT services have now been restored at the Crowne Plaza Hotel, Mayur Vihar, New Delhi.

2. Mr. Akhil Sibal, learned counsel for the Petitioners submits that the agreement between the parties itself contemplates that the data on the server located in Holiday Inn, Mayur Vihar, New Delhi can be accessed by both the parties. He states that the Petitioners are in the process of getting the data pertaining to Crowne Plaza Hotel, Mayur Vihar, New Delhi segregated and that the process of migration is likely to be completed with the cooperation of the Respondents within a period of around five weeks. He expresses the hope that the Respondents will be prepared to sit with the Petitioners to O.M.P.(I) (COMM.) 398/2016

work out a schedule acceptable to both parties to facilitate the migration of the data.

3. Mr. Siddharth Khattar, learned counsel for the Respondents states that there should be no difficulty in Respondents sitting with the Petitioners to work out such a schedule and assures that the full cooperation of the Respondents will be extended for that purpose. It is further stated that as regards providing access to the Petitioners to the server room, the Respondents will abide by the Services Sharing Agreement dated 24th December 2013.

4. In view of the above statement, no further directions are called for. The petition is disposed of in the above terms.
