2. The Registry is directed to register the present matter as a criminal appeal and assign it a number accordingly.

3. The learned counsel for the petitioner and the respondent is present online. The learned counsel for the petitioner identifies the respondent, who is appearing in person.

4. It is submitted by the learned counsel for the petitioner that the matter has been settled in the mediation. The settlement agreement is taken on record.

5. Hence, the acquittal is confirmed in the light of the settlement arrived at and the respondent/ accused acquitted in terms of Section 320(8) Cr.P.C. The parties shall be bound by the settlement. The settlement agreement shall form part of the record.

6. The appeal stands disposed of in terms of the settlement agreement.

7. Pending application shall also stand closed.

8. The FDR of the respondent/ accused which has been deposited before the appellate court shall be released to them.
