% 15.10.2015 Learned counsel for the plaintiff submits that in terms of the deed of settlement dated 17th September, 2015 between the parties, defendant has handed over the possession to the plaintiff. He further submits that suit is not pressed. Accordingly, suit is disposed of as not pressed. Miscellaneous applications are disposed of as infructuous.

Since parties have settled their disputes before the commencement of trial, let 50% of the court fee be refunded to the plaintiff and necessary certificate in this regard be issued by the Registry. A.K. PATHAK, J.
