O R D E R

% 07.10.2016 Present writ petition has been filed seeking quashing of permission whereby respondent no. 1-DDA has allowed residents of Nilgari Apartments to install a lift.

Today, learned counsel for respondents states that present writ petition has become infructuous inasmuch as the lift has been installed and the licence for working of the lift has been granted by the Inspector of Lifts. Learned counsel for respondents also states that lift has been installed in accordance with the policy of DDA after obtaining requisite permission from all statutory authorities.

Since the lift is operational and licence for working of the same has also been granted, present writ petition and applications are disposed of as infructuous with liberty to the petitioners to challenge the licence that has been granted for working of the lift as well as the policy that has been formulated by the DDA.

However, it is clarified that this Court has not expressed any opinion on the merits of the controversy. Rights and contentions of all parties are left open.
