This is an application moved on behalf of the applicants/surviving legal heirs seeking relief to the effect that 50% of the balance amount awarded by the learned Tribunal vide order dated 28.02.2017, be released to them along with the up-to-date interest. Further, it is also requested that the schedule of payment of balance amount as awarded by this Court vide judgment dated 09.01.2024 be modified and be re-scheduled keeping in view the fact and circumstances of this case.

Learned counsel for the non-applicant/appellant-Insurance Company is present and she requests for a short accommodation on the ground that Mr. Pradeep Gaur, Advocate is unwell. Request for accommodation is declined.

The present application is disposed of with the directions that the applicant shall be at liberty to move the appropriate Court for seeking execution and recovery of the balance amount of compensation as enhanced by this Court vide judgment dated 09.01.2024 before the learned Tribunal. Since no compelling grounds are shown, the request for re-schedule of the payment of compensation is disallowed.
