% 15.12.2017 It is submitted that petitioner and respondent no. 2 have settled their disputes amicably in respect of subject matter involved in the FIR No.147/2016 under Sections 279/337 IPC read with Sections 177/RR17(1) of the Motor Vehicles Act registered at Police Station North Rohini, vide a Memorandum of Agreement dated 15th May, 2017. It has been further pointed out that MACT proceedings were also initiated by respondent no. 2, wherein also settlement was arrived at before the Mediation Centre on 1st April, 2017 whereby insurance company had agreed to pay `1,20,000/- to the respondent no. 2 towards full and final settlement of all the claims of
respondent no. 2 in the said MACT claim.
As regards present FIR is concerned, it is contended that petitioner has agreed to pay `1,70,000/- to the respondent no. 2 and the same is acceptable to the respondent no. 2. Petitioner has paid `1,70,000/- to respondent no. 2 today in Court vide a demand draft, photocopy whereof has been placed on record. Respondent no. 2 submits that he is not willing to pursue the FIR any further against the petitioner and the same may be quashed.
Keeping in mind the settlement arrived at between the petitioner and respondent no. 2 voluntarily, in the interest of justice, FIR No. No.147/2016 under Sections 279/337 IPC read with Sections 177/RR17(1) of the Motor Vehicles Act registered at Police Station North Rohini and the consequent proceedings emanating therefrom are quashed.
