% 26.02.2016 By this writ petition under Article 226 of the Constitution of India, petitioners have prayed that respondent nos. 1 and 2 be directed to stop and demolish the unauthorised construction raised in the property bearing no. 3243, Gali Peepal Mahadev, Hauz Qazi, Delhi - 110006. Status report has been filed by the respondent no. 1.
It is submitted by the counsel for respondent no. 1 that unauthorised construction has already been booked, inasmuch as demolition order has been passed on 26th February, 2015. It is further submitted that partially demolition action was taken on 19th
December, 2015.
Remaining demolition action was deferred for 5th January, 2016 but same could not be carried out in absence of adequate police force. It is further submitted that demolition action has now been fixed for 4th March, 2016. SI Parveen Badsara, P.S. Hauz Qazi is present in Court and submits that adequate police force would be provided to the respondent no. 1 on 4th March, 2016. Respondent no. 1 is directed to complete the demolition action on 4th March, 2016 and remove the debris and recover the charges from respondent no. 3, in accordance with law. It may be noted that property has already been sealed. No further orders are required to be passed in the writ petition and the same is disposed of in the above terms. Compliance report be filed by the respondent no. 1 within four weeks. A.K. PATHAK, J.
