By the order under appeal dated 22.09.2016, the learned Single Judge dismissed C.M.No.34599/2016 in W.P.(C) No.354/2016 wherein the petitioners/appellants herein sought stay of allotment of Flat No.1, Pocket-II, Block-E-2, Sector-18B, Dwarka to any third party during the pendency of the writ petition.

Having regard to the fact that the main writ petition is still pending, we are of the view that it is not necessary for us to enter into the merits of the case and express any opinion on the rival submissions made by the learned counsels for the parties.

It is brought to our notice that the main writ petition now stands listed on 14.12.2016 and the pleadings are complete. LPA 577/2016 Page 1 of 2.

In these circumstances, we dispose of the appeal with a request to the learned Single Judge to hear both the parties and decide the writ petition itself without having regard to the views expressed by the learned Single Judge in the order under appeal dated 22.09.2016.
