Though this application is titled under Order XXIII Rule 1 CPC, the same is under Order XXIII Rule 3 CPC as subject matter of the appeal and other aspects have been compromised as per the terms stated in the present application.

The application is signed by the parties and their counsels and is supported by affidavits of the parties.

Application is, therefore, allowed and appeal is disposed of as per the agreed terms stated in this application.

Out of the total amount deposited in this court, and which has

also earned interest, from the total of this amount, the appellant be released 60% of the total amount by the Registry of this Court and the respondent be released the balance 40% of the total amount. 4.
