O R D E R

% 07.10.2016 This petition pertains to the short term tender notice issued on 18.09.2016 by the North Central Zone Cultural Centre which is an autonomous body of the Central Government under the Ministry of Culture with its head office at 14, C.S.P. Singh Marg, Allahabad, U.P. The said tender was inter alia for local transport services on hire basis. The petitioner along with others had participated in the said tender. However, the said tender was recommended for discharge by the tender evaluation committee on the ground that there were technical flaws in the tender document as extra hours and extra kilometre rates had not been asked for and, secondly, it has not been specified that the participating firms should be owners of the vehicles.

Because of this, it was not possible for the tender evaluation committee to arrive at a final conclusion and therefore it recommended on 17.09.2016 that the tender may be discharged on technical grounds and a fresh tender may be called.

We do not see any mala fides or arbitrariness in the action taken by the respondents in discharging the tender which was purely on technical grounds. No interference with the same is called for.

The writ petition is dismissed.
