This petition has been filed assailing impugned order dated 10th April 2015, by which final maintenance of Rs.5,000/- per month to respondent-wife has been awarded.

Petitioner was married to respondent-wife on 12th December 1996 at Agra, U.P. and three children were born out of this wedlock, who are in the custody of petitioner-husband and have now become major. There were allegations of dowry demand of Rs. 1 lakh by petitioner's family which had to be arranged by respondent's father. There were also allegations of severe physical abuse.

Respondent-wife had prayed for maintenance of Rs. 10,000/- per month for managing her livelihood since she was totally dependent. the jewellery shop of his father but involved in some jewellery work, his salary estimation was taken at Rs.50,000/- per month. Even otherwise, the Court was conservative in awarding only Rs.5,000/- towards the wife.

Counsel for petitioner states that the petitioner does not even has a house and is staying in a temple. However, these circumstances would have no bearing on an order passed way back in 2015 and where no money had been given to wife, since the order has been passed. 5.

The Court does not find any infirmity or illegality with the said order and direction of maintenance of Rs.5,000/- per month is just and proportionate.

Accordingly, this petition is dismissed.
