Present petition under Section 482 Cr.P.C. has been filed by the petitioner for quashing of FIR No.387/2015, under Section 135 r/w section 150 of Indian Electricity Act, 2003 registered at Police Station Amar Colony.

Learned counsel for the petitioner submits that the petitioner has already settled the matter with the BSES and paid a sum of Rs.1,16,818/- and seek the quashing of the aforesaid FIR.

Learned counsel for the BSES submits that they have no objection if the present FIR is quashed as the matter has been settled with the BSES. 4.
Learned counsel for the State also submits that he has no objection if the present FIR No.387/2015 is quashed. Moreso, they are only performa party.

Statements of the petitioner as well as of Mr. Pradeep Baisoya, AR of the complainant/respondent No.2 for the BSES have been recorded separately to this effect.

In view of the aforesaid statements, the FIR No.387/2015, under Section 135 r/w section 150 of Indian Electricity Act, 2003 at Police Station Amar Colony and all the proceedings emanating therefrom are quashed. 7.
The petitioner is, however, burdened with costs of Rs.10,000/- to be deposited with the Prime Minister National Relief Fund within two weeks. The Registry shall ensure the compliance of the order. 8.
The petition stands disposed of accordingly.
