% 31.05.2017 The petitioner is in custody after being arrested during the course of investigation into FIR No. 58/2016 under Sections 302/34 IPC, police station Burari, the investigation has been completed. On the charge-sheet laid before the metropolitan magistrate from where upon committal it has since come before the Court of sessions which has even framed charges. There is a direct evidence of eye witnesses indicating involvement of the petitioner in the deadly assault with knife on the person of the victim. In these facts and circumstances when the material witnesses are yet to be examined, no case for bail is made out.

Dismissed.
