% 03.08.2017 The petitioner seeks bail in connection with FIR No.600/2016 dated 05.06.2016 (PS Aman Vihar) instituted for the offences under sections 323/365/366/377/506/34 of the IPC.
The victim is said to have been sodomised by co-accused Manoj. The petitioner is alleged to have abetted and facilitated the aforesaid occurrence.
It has been submitted on behalf of the petitioner that he has been falsely implicated in this case. The reason for false implication is that the sister of the petitioner was having an affair with the complainant which was being objected to by him. It has further been submitted that co-accused Arif, who too is alleged to have participated in the occurrence but without any specific overt act, has been granted bail by the Court below. The petitioner is stated to be in custody since 31.01.2017.
Taking into account the aforesaid facts, this Court is inclined to admit the petitioner on bail.
Let the petitioner be released on bail on his furnishing bond in the sum of Rs.5,000/- with one surety of the like amount to the satisfaction of the Trial Court.
This application is disposed of.
