% 31.05.2017 The petitioner, who is working as a Constable in Railway Protection Force, had undergone open heart surgery on 29th April, 2016. 2.

The petitioner was called and examined at the Divisional Railway Hospital, Ambala Cantt., Haryana on 1st September, 2016 and was declared fit.

The petitioner had made a representation for re-examination by a medical board as he perceives and believes that he is not medically and physically fit.

The representation of the petitioner was forwarded by the Senior Divisional Security Commissioner to the Chief Medical Director, Northern Railway, Baroda House, New Delhi and has remained pending for more than six months.

Learned counsel for the respondents, who is present on advance notice, states that if the representation of the petitioner has not been disposed of, it would be disposed of within a period of four weeks from today and the petitioner would be communicated and informed. We are assured that the case of the petitioner would be examined in accordance with law. 6.

In view of the statement made by the counsel for the respondents, the writ petition is disposed of, with liberty to the petitioner to revive the cause, if required, by moving an appropriate application or by filing a fresh writ petition.
