TR.P.(C.) 95/2017 1.

This petition has been filed under Section 24 of the Code of Civil Procedure seeking transfer of H.M.A. No.441/2017 filed by the respondent herein from the Court of Family Court, Shahdara District, Karkardooma Courts, Delhi to the Family Court, North East District, Karkardooma Courts, Delhi.

The transfer has been sought on the ground that the Court of Principal Judge, Family Court, Shahdara District is lying vacant. 3.

Notice. Counsel as above accepts notice of this petition on behalf of the respondent and submits that HMA No.441/2017 has been filed under TR.P.(C.) 95/2017

Section 13-B (1) of HMA Act for divorce by way of mutual consent. 4.

He further submits that he has no objection if the petition bearing HMA No.441/2017 filed by him in the Family Courts, Shahdara District, Karkardooma Courts, Delhi is transferred to the Family Court, North East District, Karkardooma Courts, Delhi.

In view of the no-objection given by the respondent, the petition bearing HMA No.441/2017 filed by the respondent and pending in Court of Family Court, Shahdara District, Karkardooma Courts, Delhi is transferred to the Court of Principal Judge, Family Court, North East District, Karkardooma Courts, New Delhi for disposal in accordance with law. 6.

The parties are directed to appear before the Court of Principal Judge, Family Court, North East District, Karkardooma Courts, New Delhi on 5th June, 2017.

It is directed that the case file of case bearing HMA No.441/2017 under Hindu Marriage Act filed by the respondent be sent to the transferee Court for 5th June, 2017.

With the above directions, the petition is disposed of. 9.

A copy of this order be sent to the Courts concerned through Special Messenger.

A copy of the order be given dasti to the learned counsel for the parties under the signature of the Court Master. PRATIBHA RANI, J.
