By way of this petition filed under Article 227 of the Constitution of India, petitioner is impugning the order dated 15th April, 2017 passed by learned SCJ cum RC, North District, Rohini Courts, Delhi in MCA No.21/15 whereby appeal filed by the petitioner/plaintiff against the order dated 14th October, 2015 was dismissed.

Today learned counsel for the petitioner submits that he may be permitted to withdraw this petition with liberty to approach the Court if there is a threat or apprehension of being dispossessed from the suit property.

The petition is dismissed as withdrawn granting the liberty as prayed for.
