Since the matter has been settled, the file of CS(COMM) 424/2017 is taken up today for disposal in terms of the settlement. 2.

The IA stands disposed of.

CS(COMM) 424/2017 & IA 7024/2017 (under Order 39 Rules 1 and 2 CPC) 1.

The matter is settled between the parties. Terms and conditions of the settlement have been incorporated in the IA No. 12988/2017, signed by the parties and their counsel.

I have enquired from the learned counsel for the parties if the matter has been settled amicably between the parties with their consent. They inform that the disputes have been resolved amicably with their free consent. They pray for decree in terms of Paras 2 to 12 of the CS(COMM) 424/2017

settlement incorporated in the IA No. 12988/2017. This Court finds no legal impediment to record the settlement. 3.

As the matter has been settled between the parties amicably, the suit of the plaintiff is decreed. Terms and conditions incorporated in Paras 2 to 12 in the settlement application i.e. 12988/2017 shall form part of the decree sheet. Decree sheet be prepared accordingly. 4.

Since the matter has been settled amicably before recording evidence, Court Fees, under Section 16A of the Court Fees Act, be refunded to the plaintiffs. Necessary certificate shall be issued. 5.

The pending IA also stands disposed of.
