% 25.07.2018 By order dated 04.04.2012, the Additional Chief Metropolitan Magistrate (ACMM) found charges made out to put the petitioners and certain others on trial for offences punishable under Sections 2(ia), (a), (m) and Sections 16(1)(a) read with Section 7 of the Prevention of Food Adulteration Act, 1954.

The said order was challenged by some of the co-accused persons by criminal revision petition (wrongly referred to as Crl. Appeal No.55/2012) which was decided by the court of Sessions by judgment dated 22.08.2012. The petitioners moved a separate criminal revision petition in January, 2013 with a prayer for condonation of delay of 222 days to be condoned. The said criminal revision petition (No.142/2/2014) was dismissed by the Additional Sessions Judge, by order dated 30.10.2014, with observations that the delay had not been properly explained.

On perusal, this court finds no error in the view taken by the Additional Sessions Judge in the order dated 30.10.2014, which is impugned by the petition at hand under Section 482 of the Code of Criminal Procedure, 1973. The lack of internal coordination in the office of the petitioner cannot justify the law of limitation to be given a go by to such extent.

The petition is dismissed.
