% 19.04.2017 CS(COMM) 1405/2016& I.A.No.12644/2016 The matter has been settled. A joint application under order 23 Rule 3 CPC (I.A.No.2038/2017) had been filed. Pursuant to which statements of respective parties had been recorded. The Joint Registrar had recorded the statement of the Authorized Representative of the plaintiff as also of defendant no.1 on oath. The terms of settlement are contained in the aforenoted application (I.A.No.2038/2017) which is also supported by the affidavits of the respective parties. This application along with the affidavit is already exhibited as Ex.C-1. Parties shall be bound by the terms and conditions contained therein. The suit of the plaintiff is decreed in terms of para 3 of Ex.C-1. Decree sheet be drawn. Suit stands disposed of.
