Vide the instant application, applicant seeks clarification in judgment / order dated 02.12.2015, whereby in Para 19 this Court observed as under: "From the above noted facts, it is crystal clear that the petitioner had admitted to have bank accounts outside India only after the investigation by the Income Tax Department. The said foreign account was the undisclosed account and the deposits therein relates to his undisclosed income and the same needs to be examined."

I hereby make it clear that the aforesaid observation made by this Court shall not prejudice the rights and contentions of the petitioner before the trial court as well as the proceedings pending in the Appeal before the Commissioner of Income-Tax (Appeals).
