O R D E R

% 16.11.2016 This is a petition under Section 482 Cr.P.C. for quashing of FIR No.464/2015, under Section 354/506 IPC, registered at Police Station-Nand Nagari, Delhi and all the proceedings emanating therefrom. Learned counsel for the petitioner has submitted that the petitioner and the complainant are neighbour and due to some misunderstanding arisen between the parties, FIR No. 464/2015, under Section 354/506 IPC was registered at Police Station-Nand Nagari, Delhi. Counsel for the petitioner has further submitted that though the matter has already been settled, however, to ensure further peaceful resolution, the petitioner will never visit the house of the complainant and shall not try to contact the complainant in any manner whatsoever and shall not make any kind of gesture which would tantamount to the bad act on his part. He further submits that later on with

the help/intervention of the friends and relatives of both the sides, the matter has been amicably settled between the parties vide settlement deed dated 22nd October, 2016 and nothing remains to be adjudicated further and prays that the present FIR in question may be quashed. Respondent No.2/ complainant, Ms.Monika Kundra is present in Court today and is identified by the Investigating Officer, SI Omveer Singh of P.S. Nand Nagari. Respondent No.2/complainant admits that the petitioner is her neighbour and she has amicably compromised/settled the matter with him. She further submits that due to some misunderstanding the FIR was registered and now no dispute is left and further submits that the settlement/compromise has taken place voluntarily, without any force, pressure or coercion.

She further submits that she has no objection if the present FIR is quashed against the petitioner. Accordingly, keeping in view the facts and circumstances of the case as the matter has been amicably settled between the parties and for the betterment of the parties in the near future as both the parties are neighbours, I deem it appropriate to quash FIR No.464/2015, under Section 354/506 IPC, registered at Police Station-Nand Nagari, Delhi and all the proceedings emanating therefrom are quashed. Parties to abide by the terms of the settlement.
