1. There is a clear statement in the petition that the land in question is a part of an unauthorized colony and that "the colony of the Petitioner had already been issued a provisional certificate of regularization bearing No. 1304 way back on 17th September 2008."

2. In view of the decision of this Court dated 10th January 2019 in W.P.(C) 3623/2018 (Akhil Sibbal v. Government of Delhi) and the decision dated 17th January 2019 in W.P. (C) 4528/2015 (Moolchand v. Union of India), the question of granting a declaration of deemed lapsing of land acquisition

proceedings under Section 24 (2) of the 2013 Act does not arise. It will be open to the Petitioner to pursue the remedy of regularization of the unauthorized colony in accordance with law.

3. The petition is dismissed. The interim order dated 28th May 2015 as confirmed on 12th February 2018 is hereby vacated. S. MURALIDHAR, J.
