% 19.10.2016 Petitioner Arjun Singh is stated to squatting near stall No.1/Shop no.1, Sarojini Nagar, Subzi Market, New Delhi since 1990. His submission is that his name was also included in the list of eligible applicants under scheme of Urban Street Vendors in the NDMC area. His additional submission is that (in view of the judgment of Bhola Ram Vs. New Delhi Municipal Council and Anr in LPA 136/2016 decided on 18.5.2016) pre-existing right holder is entitled to a protection. His further submission is that he is protected under Section 3(3) of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014.
Per contra, submission of learned counsel for respondent is that list of eligible applicants under scheme of Urban Street Vendors in
the NDMC area relied upon by the petitioner is not the approved list. However, it is not in dispute that the Town Vending Committee of the respondent no.1 has since been constituted. This petition is disposed of with liberty granted to the petitioner to approach the Town Vending Committee of respondent.
