% 08.11.2016 Statement of Mohd.Ismile s/o Late Shri Abdul Sattar Mirza has been recorded in Court today. He has undertaken to the court to vacate the property being Shop No.686, Chitla Gate, Chawri Bazar, Delhi-110006 to the respondent on or before 30.9.2018. He has also undertaken other terms and conditions in his undertaking.

He shall remain bound by the undertaking.

In view of the above undertaking, learned counsel for the petitioner submits that he does not press the present Revision Petition. Learned counsel for the respondent submits that in view of the undertaking of the petitioner to vacate on or before 30.9.2018 the respondent shall not execute the Eviction Order before 30.9.2018. Petition stands disposed of. All pending applications, if any, also stand disposed of accordingly.

I undertake to the Court to hand over vacant physical possession of the property being Shop No.686, Chitla Gate, Chawri Bazar, Delhi-110006, as described in the Eviction Petition, to the respondent on or before 30.9.2018. I undertake to the court that I am in possession of the full tenanted property as prescribed in the Eviction Petition and that there is no other LR of Late Smt.Fatima Begum in possession of the property. I undertake not to induct any third party in the property or cause any wilful damage to the property. I will pay the agreed rent, electricity and water charges for the period I am in occupation. I admit the bona fide requirement of the respondent.
