% 04.02.2020 Vide the present petition, the petitioner has challenged the judgment and order dated 21.04.2017 passed by learned District and Session Judge, (South District), Saket, New Delhi whereby the petitioner was convicted and sentenced with imprisonment for one year SI for the offence punishable under section 304-A IPC, six months SI for the offence punishable under section 279 IPC and six months SI for the offence punishable under section 337 IPC.
All the above sentences shall run concurrently. It is not in dispute that as on date, the petitioner has completed six months imprisonment out of one year.
Learned counsel for the petitioner submits that he does not dispute the conviction order, however, he may be directed to be released on the period he has already undergone by modifying the order dated 21.04.2017. Keeping in view the submission of counsel for the petitioner, I hereby
while maintaining the conviction modify the order dated 21.04.2017 and reduce the sentence of the petitioner from one year to six months. Copy of this order be sent to the Jail Superintendent and Trial Court concerned for information.
