This appeal is disposed of with the consent order that appellant/defendant will have a 70% ownership in the property bearing no.712, 3rd Floor, J.J. Colony, Raghubir Nagar, Opposite Vishal Cinema, New Delhi and the respondent/plaintiff (since deceased and now represented through legal heirs) will have a 30% share.

A preliminary decree is accordingly passed. Final decree proceedings are now required to be taken up by the trial court.

Parties to appear before the District & Sessions Judge, West,

Tis Hazari Courts, Delhi on 31st January, 2019 and the District & Sessions Judge will now mark the suit for final decree proceedings to a competent court in accordance with law.
