% 11.09.2018 Learned counsel for the petitioner contends that petitioner has not been named in the FIR. The FIR contains statements of injured-Mr. Ravi Gupta as well as her wife-Ms. Alka Gupta. Both of them have stated in the FIR that Javed and Surender Sodhi @ Shammi had come to their house and Shammi fired a gun shot resulting injuries to Ravi Gupta while Javed controlled Shammi and, thereafter, removed Ravi Gupta to hospital. Learned APP has not disputed the above factual position. However, she states that on the same day statements under Section 161 Cr.P.C. of Ravi Gupta and his wife Alka Gupta were recorded wherein they stated that petitioner was also accompanying Shammi and Javed, inasmuch as, petitioner had exhorted by saying that Ravi Gupta be finished that day.
Petitioner is in custody for the last six months. Keeping in view the facts and circumstances of this case more particularly that role of firing gun short has not been assigned to the petitioner, it is ordered that petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `25,000/- with one surety in the like amount to the satisfaction of the trial court.
Bail application is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
