% 07.11.2016 Address of the petitioner has been verified by the respondent. Learned ASC for the State submits that there is possibility of petitioner jumping the parole.
Learned counsel for the petitioner submits that petitioner was released on parole last year and had surrendered before the Superintendent Jail after completion of parole period. A perusal of nominal roll shows that petitioner was released on parole with effect from 9th October, 2015 to 9th November, 2015.
It is not the case that he had misused the concession of parole extended to him on earlier occasion.
Petitioner's son is living with his mother and this fact has been verified.
Keeping in mind totality of the circumstances, it is ordered that petitioner be released on parole for a period of one month from the date of
his release, subject to this furnishing a personal bond in the sum of `5,000/- with one surety in the like amount to the satisfaction of the Superintendent Jail. During the parole period, petitioner shall report to SHO of police station Aman Vihar once in a week on Mondays at 10:00 am. After completion of parole period, petitioner shall surrender before the Superintendent Jail.
Writ petition is disposed of in the above terms. A.K. PATHAK, J.
