By this writ petition, the petitioner seeks compassionate employment on account of the death of her husband Sh. Vivek Kumar, who was an employee of the respondent no.2/Bharat Heavy Electricals Ltd. Learned counsel for the petitioner, on instructions from the petitioner who is present in person, admits that the present case involves disputed questions of facts which will be decided after leading evidence, and therefore, liberty be granted to the petitioner to withdraw this writ petition so that petitioner may file a suit to seek the same reliefs and in which suit petitioner be given the benefit of Section 14 of the Limitation Act, 1963. W.P.(C) No.6484/2015

In view of the above, this writ petition is allowed to be withdrawn and petitioner will be granted benefit of Section 14 of the Limitation Act with respect to the period for which the present writ petition remained pending in this Court.

Writ petition is accordingly allowed to be withdrawn with the aforesaid liberty and observations.
