O R D E R
% 27.04.2016 The abovementioned petition has been filed by the petitioner under Section 34 of the Arbitration and Conciliation Act, 1996 challenging the impugned Award dated 4th March, 2015.
During the pendency of the petition, by order dated 18th January, 2016 the matter was referred to the Samadhan, Delhi High Court Mediation and Conciliation Centre. After various meetings, the parties have settled their disputes. The original Settlement Agreement dated 23rd March, 2016 is placed on the record. The terms and conditions of the settlement are mentioned in the said Settlement Agreement.
The same is duly signed by the parties as well as their respective counsel. It is also signed by the learned Mediator. The parties shall be bound by the terms and conditions of the settlement. Learned counsel for the respondent submits that as per the settlement,
the respondent was to receive a total sum of Rs.1,60,00,000/- as full and final settlement, out of which the respondent has already received a sum of Rs.1,53,60,000/- and the remaining amount of Rs.6,40,000/- has been deduced as TDS by the petitioner.
Counsel further submits that the petitioner is required to handover the TDS certificate(s) in respect of the said deductions to the respondent. No one appears on behalf of the petitioner when the matter is taken up.
In view of the settlement arrived at between the parties, the present petition is accordingly disposed of. The petitioner is directed to hand over the TDS certificate(s) to the respondent or through counsel, within three weeks from today.
