The petitioners seek anticipatory bail in case FIR No.404/20I6 : under Sections 323/341/308/307/34 IPG registered at Police Station , Pandav Nagar. Status reports are on record.

I have heard the learned counsel for the. parties .including the counsel for, the complainant and have examined the file. The petitioners-Hukam Singh @ Hukka, Chetan @ Ashu and Saurabh @ , Inder were granted interim, protection and were directed .to join the investigation as and when required vide orders dated 07.11.2016, ! 17.11.2016 and. 17.10.2016 respectively.' Undisputedly, they have n joined the investigation since then.

Initially the FIR was registered under Sections 323/341/34 IPG. Subsequently, Sections 308/307/325 IPG were added. Status report reveals that co-accused Arjun @ Ujjay, Mahinder Singh s/o Hukam ;

, Ghand and Surinder @ Twinkle have been arrested and are on regular n bail.

Status report further reveals that initially in the FIR the complainant Rakesh Kumar had named six assailants to have inflicted injuries on him. Subsequently, in 164 Cr.P.C. statement the number of assailants was described as seven.

During investigation Ramchandar @ Bhole was found to be a labourer ; whose , identify/address could not be traced out. The petitioner Saurabh @ Inder was found present in the CCTV footage at 4.22 p.m. in Tilak V Nagar which is at a distance of 22-25 kilometers. 5.

The role assigned to the petitioners is of catching hold of the victim and, of provocation. The incident had taken place suddenly on a trivial issue.

Considering the facts and circumstances of the case and the role assigned to the petitioners, they are admitted to anticipatory bail and in the event of their arrest, they be released on bail on their furnishing . personal bond in the sum of ?40,000/- each with one surety in the like amount to the satisfaction of the SHO/Investigating Officer with ;

the condition that they shall join the investigation as and when : required.

The bail applications stand disposed of.
