Minakshi Maheshwari v. Union Of India & ANR.
$~18 *
IN THE HIGH COURT OF DELHI AT NEW DELHI
+ W.P.(C) 5892/2015 MINAKSHI MAHESHWARI ..... Petitioner Through:
Petitioner in person.
versus UNION OF INDIA & ANR.
..... Respondents Through:
Ms Monika Arora, CGSC with Mr Kushal Kumar, Advocate for UOI.
CORAM:
HON'BLE MR. JUSTICE VIBHU BAKHRU
O R D E R
% 19.07.2017 1.
Ms Monika Arora, CGSC appearing for the respondents states that the photocopies of all documents that were available with respondent no.2 have been furnished to the petitioner. The petitioner in person also states that she has received certain documents, however, complains that the same are incomplete.
2.
It is the conceded position that certain documents available with respondent no.2 are missing or are untraceable. Ms Arora states that a fact finding committee was also constituted and the committee also reported that certain documents were missing. She states that the said report would be followed up and after fixing the responsibility for the loss of documents further action, if necessary, would be initiated within a period of twelve weeks.
3.
In this view, this court is not persuaded that any further directions are
warranted in this matter at this stage.
4.
The petitioner submits that one of her grievance stems from the fact that in another proceeding before the Bombay High Court, it was stated that an order dated 26.10.2013 was passed by respondent no. 2, however, no such order was passed and none existed on the records of the respondents. She has also drawn the attention to the passage of the report of the fact finding committee, which also supports the aforesaid assertion. This Court is not called upon to examine or comment on whether a particular document existed or did not; it is always open for the petitioner to raise this contention in the proceedings before the Bombay High Court and support the contention with whatever materials that is available, either with the petitioner or the respondents.
5.
The petition is disposed of with the aforesaid observations. 6.
Order dasti.
