Learned counsel for the petitioner submits that the issue revolves around the medical insurance policy of his father-Shri B.C. Bhattacharjee and his mother-Smt. Seema Bhattacharjee. He submits he has spent about Rs. 8 lacs from his savings and is suffering from financial difficulties on account of the same as the respondents are not disbursing the medical expenses though the petitioner is shown as a contingent nominee in the medical insurance policy of the father.

The issue involved appears to be small inasmuch as it rotates around the interpretation of the medical insurance policy issued by the respondents. CM(M) 1246/2016

Learned counsel for the petitioner submits that he would request the trial court for disposal of the matter without evidence as it is based on interpretation of documents.

If the trial court does not accept the above prayer of the petitioner, keeping in view the facts and circumstances of this case, the trial court may expedite recording of evidence and disposal of the case. The evidence should not take a long time. Needful be done preferably within a period of 9 months from today. No adjournment should be granted to any of the parties on the dates to be fixed for the evidence.

In view of the above, the present petition stands disposed of. 6.
