% 12.07.2017 The impugned order dated 05.05.2017 adjourns the case for the reasons recorded therein to 25.09.2017. The impugned order is not appealable. Learned counsel for the appellant submits that they want early disposal of the application under Order 39 Rule 1 and 2 CPC. The appeal is not maintainable for the said purpose. Such request and prayer should be made before learned Single Judge.

In view of the aforesaid observation, appeal is dismissed as not maintainable.
