% 17.11.2017 Counsel for the petitioner states that an appeal has been preferred under Section 260A of the Income Tax Act, 1961 against the order of the Tribunal dated 20th January, 2016 in ITA No. 2483/Del/2014. He submits that the petitioner would raise all issues and contentions, which are raised in the present writ petition in the statutory appeal. In view of the statement made by the counsel for the petitioner, the writ petition is dismissed as withdrawn with liberty to the petitioner to raise all contentions and issues in the appeal. We clarify that we have not expressed any opinion on merits.
