% 17.11.2016 This is an application under Section 439 read with Section 482 Cr.P.C. filed on behalf of the petitioner seeking grant of bail in case FIR No.497/2011, under Sections 363/328 IPC, registered at Police Station Jamia Nagar, New Delhi.

Learned counsel for the petitioner has submitted that the petitioner is an innocent person having no nexus with the FIR bearing No.497/2011, under Sections 363/328 IPC, P.S. Jamia Nagar, New Delhi. He has further submitted that the petitioner is in judicial custody since 21.09.2011 and submitted that since the petitioner is not required for further investigation, the petitioner may be released on bail.

On the other hand, learned APP for the State and the Investigating Officer vehemently opposes the bail application and submitted that the

present bail application may be dismissed.

Heard learned counsel for the parties and perused the record. It is apparent that the present petitioner is in judicial custody since 21.09.2011 and the trial of the case has not been concluded even after lapse of five years. It is brought to the notice of this Court that further proceedings before the Trial Court have been adjourned sine die till date and is likely to take further time. In these circumstance, no purpose would be served if the petitioner is kept further in judicial custody. Hence, I admit the petitioner to bail on his furnishing bail bond in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of the CMM/MM concerned.
