% 08.08.2017 IA No.8897/2017 This application under Order 23 Rule 3 of the CPC moved by the parties after having settled the disputes inter se in terms of para No.3 of this application. Both the parties have reached the settlement of their own free will without any pressure, coercion and threat and the settlement so arrived is lawful settlement and there is no impediment in taking such settlement on record. Considering the submissions so made and averments made in the application, the suit of the plaintiff is decreed in terms of the averments contained in para No.3 of the application read with memorandum of settlement Annexure A and schedule of the properties Annexure B, which shall form part of the decree. The application is disposed of.
