1. The Petitioner, a lawyer, has approached this Court stating that despite his client Mohammad Jahangir, son of Mohammad Janif, being granted bail in FIR No.528/2017 registered at PS Amar Colony by an order dated 20th July 2018, the said Mohammad Jahangir has again been illegally detained by the police.

2. This petition was urgently mentioned before this Court on 7th September 2018 and notice was issued to the Respondent on that date itself. The petition was kept for today.

3. A status report has been filed by Inspector Sahib Singh, Station House Officer of PS Sarai Rohilla clarifying that apart from the above said FIR No.528/2017 registered at PS Amar Colony, there was an WP (Crl.) 2683/2018

earlier FIR No.327/2013 registered at PS Sarai Rohilla against Mohammad Jahangir under Section 356/379/411 IPC. He had been declared a proclaimed offender in that FIR and it is pursuant thereto that he has again been detained in the said FIR.

4. Mr. Rahul Mehra, learned Standing Counsel for the State, has shown to the Court the relevant documents concerning the arrest of Mohammad Jahangir and the last order passed by the learned Metropolitan Magistrate-IV on 6th September 2018 remanding Mohammad Jahangir to judicial custody.

5. In the circumstances, the question of entertaining the present habeas corpus petition does not arise. It will be open to Mohammad Jahangir to seek other remedies as may be available to him in accordance with law.

6. The petition is disposed of accordingly.
