% 07.03.2019 The compliance affidavit has been filed on behalf of respondent No.1 wherein respondent No.1 has stated that the recruitment rules for the post of Additional Director General (Quantity Surveying and Contract) Cadre, ADG (SQ&C) have been published on 02.03.2019 in the Gazette Notification under Part-II/Section-IV in the Ministry of Defence SRO No.31. The notification has, however, not been received. The rules framed are nomenclatured as Military Engineer Services (Quantity Surveying and Contract Cadre), Additional Director General (Arbitration), Group 'A' Post Recruitment Rules, 2019. The final rules have been placed on record as an Annexure to the compliance affidavit filed by the respondent No.1. The

affidavit also states that the proposal for DPC has been submitted to the UPSC on 27.02.2019 through the single window system. Mr.Kaushik, who appears for the UPSC, states that on priority a member has been nominated and the DPC is scheduled to be held on 18.03.2019.

In view of the fact that there has been substantial compliance of our order dated 24.01.2019, we do not propose to pass any further orders except to state that, considering the fact that the petitioner is due to retire on 30.04.2019, we hope and expect that, to treat the petitioner fairly, the DPC shall be held as scheduled so that he knows his fate before retirement. The petition stands disposed of.
