File taken up today on an office note regarding receipt of letter dated 22.02.2016 from the Superintendent, Jail No.2, Tihar Jail, New Delhi. 2.

Alongwith the office note, letter dated 22.02.2016 received from the concerned Jail Superintendent has also been annexed, which has been perused. It is mentioned in the letter dated 22.02.2016 that in pursuance of order dated 01.10.2015 passed in W.P.(Crl.) No.1264/2015, the petitioner has been released on 07.11.2015 on furlough for a period of three weeks, however, the petitioner did not surrender after expiry of period of furlough. Thereafter, WTM No.8485 dated 03.12.2015 was flashed to all concerned agencies for re-arresting the petitioner and ultimately, the petitioner was re-arrested on 12.02.2016 and sent to jail to serve the remaining sentence. 3.

By this communication, the concerned Jail Superintendent also seeks permission to forfeit the surety amount as the surety has violated the W.P.(CRL) 1264/2015

conditions of the surety bond and failed to produce the petitioner for surrender on expiry of period of furlough.

Proceedings against the surety may be initiated in accordance with the relevant provisions contained in Code of Criminal Procedure. Copy of the order be sent to the concerned Jail Superintendent for information and compliance.
