This petition under Article 227 of the Constitution of India impugns the order dated 26th April, 2017 of the learned Additional District Judge (ADJ) adjourning the consideration of the application filed by the petitioners/plaintiffs under Order XXXIX Rule 2A of the Code of Civil Procedure, 1908 (CPC) to 27th July, 2017.

It is the contention of the counsel for the petitioners/plaintiffs that the application is being adjourned since January, 2017. 5.

I am of the view that Article 227 of the Constitution does not permit this Court to interfere in the proceedings of the Court of the CM(M) 682/2017

ADJ in the manner sought. Moreover, the matter is coming up before the ADJ on 27th July, 2017 and I am confident that definitive steps in the proceedings will be taken on that date.

With the aforesaid observations, the petition is dismissed. No costs.
