After arguments, counsel for the appellants sought a pass-over to take instructions. After taking instructions, it is agreed that this appeal is disposed of with the consent order that the appellants will vacate the suit premises which is in their possession i.e first floor and second floor of the property bearing no. V-26, Rajouri Garden, New Delhi on or before 31.12.2021. It is also agreed that respondent no.1 will not claim any charges for use and occupation from the appellants till the appellants stay in the suit premises but the appellants undertake to clear all charges towards water electricity etc as payable for the suit premises till the appellants stay in the suit premises.

Let the appellants file an affidavit of undertaking in terms of the present order in this Court within a period of one week and on the appellants filing an undertaking and complying with the terms of the same, appellants are granted time to vacate the suit premises on or before 31.12.2021.

The appeal is accordingly disposed of in terms of the aforesaid observations.
