% 08.11.2016 By this revision petition, petitioner has assailed the order dated 12th August, 2016 passed by the learned Metropolitan Magistrate, Delhi, whereby application under Section 142 (b) of the Negotiable Instruments Act, 1881 has been dismissed. As a matter of propriety, petitioner should approach the Sessions Court at the first instance. Learned counsel for the petitioner seeks leave to withdraw this petition with liberty to approach the Sessions Court.

Petition is disposed of as withdrawn.

Miscellaneous application is disposed of as infructuous. In case revision petition is filed

before the Sessions Judge within two weeks from today, the same shall be heard and disposed of on merits without going into the question of limitation. Dasti.
